1. About these terms
These terms apply when you use mckinsley-white.ca, or book a consultation. They are offered by Sean G. McKinsley, RCIC, CICC R529731, and Kimberly J. White, RCIC, CICC R712483, acting in their personal capacity; no company operates this site. By using the site or booking a consultation, you agree to them.
2. Using this website
Use the site lawfully. Don’t try to disrupt it, access areas not meant for you, or submit other people’s personal information without their permission. Our forms don’t accept documents; please don’t send them by other means through the site.
3. General information only
Content on this site is general information. It is not advice on your situation and doesn’t create a client relationship. Official Government of Canada, Provincial and/or Territorial Requirements change; check the official source and its date before relying on anything. See our Disclaimer.
4. Consultations
- A consultation is a paid professional session with one of our practitioners about your situation.
- Advice given depends on the information you provide. If information is incomplete or inaccurate, the advice may not fit your case.
- You must accept our Initial Consultation Agreement before the consultation.
- A consultation is not an application and does not mean we represent you. Representation starts only when we both sign a Retainer/Service Agreement.
- We may decline a booking, for example where there is a conflict of interest. Fees in that case are handled under the Initial Consultation Agreement and our Refund policy.
5. Prices and payment
Prices are in Canadian dollars. Our fees are charged plus applicable GST. Online payments are made by credit card and processed by Stripe. Booking a consultation is free: the consultation fee is earned only after substantive review of the information you provide when booking (and any documents we later request through our secure client process), issue identification, program analysis and preparation for your video call have been performed (opening a file alone doesn’t earn it); we invoice completed services, payment must be made before the video call, and the 30-minute video call is included with no separate fee, as set out in the Initial Consultation Agreement. Government fees are never included in our prices unless we say so in writing.
6. Cancellations, rescheduling and refunds
- Consultation cancellations and refunds follow sections 14 to 17 of the Initial Consultation Agreement. If you cancel before preparation has begun, no fee is earned or invoiced. Once the preparation has been completed and invoiced, the fee is earned and isn’t refunded merely because you change your mind, subject to the CICC Code and rights that can’t be waived. See our Refund policy.
- Consultations are governed by the signed Initial Consultation Agreement; representation by the signed Retainer/Service Agreement.
- Rescheduling or cancelling a consultation: tell us as soon as reasonably possible. If you cancel before preparation has begun, no fee is earned or invoiced (Initial Consultation Agreement, section 14). Once the preparation has been completed and invoiced, the fee is earned and isn’t refundable merely because the video call didn’t take place at the scheduled time; where reasonably practicable, we may permit the call to be rescheduled (section 15). If we can’t hold the call, we’ll use reasonable efforts to offer a replacement time, and otherwise we’ll make any fee adjustment, credit or refund that the CICC Code or applicable law requires (section 16).
